You will <br />recall that on August 2, 1983, I informed you that their technical <br />revision application was incomplete, because it lacked an analysis of the <br />potential subsidence effects of underground mining known by the operator <br />to exist beneath portions of the proposed waste pile expansion, as <br />required by Rule 2.05.3(8)(a)(i)(D). <br />Subsequent to issuance of that opinion, Sundance Coal Company <br />submitted a letter and attached map to the Division, in response to our <br />initial completeness comments. That lettei recognizes the necessity of <br />the required subsidence evaluation, but requests its deferral until <br />future planned underground mine working configuration decisions are <br />completed by the company. In their supplemental submittal the company <br />requests that permission be granted to place coal processing waste in a <br />restricted area delineated on the map attached to their supplemental <br />letter. This area does not include any of the areas potentially affected <br />by previbua known undermining. Therefore, this restricted area can be <br />considered without the subsidence evaluation required by Rule <br />2.05.3(8)(a)(i)(D). <br />For purposes of considering amendment of the coal processing waste <br />pile, limited to the two lower-most 50 foot thick terrace benches within <br />the restricted area delineated on the supplemental map, I now consider <br />the amended technical revision application complete. I have also <br />completed an adequacy review of the amended T.R. application, a summary <br />of which appears hereafter. With minimal editorial amendment, I believe <br />the following adequacy comments may also serve as findings for.your <br />eventual technical revision decision document. <br />Adequacy Review: <br />Sundance Coal Company previously obtained approval for construction <br />of a 1,000,000 cubic yard coal processing waste pile within the permit <br />423 Centennial Building, 1313 Sherman Street Denver.
