Completeness Determination:
I have completed a second completeness review and combined adequacy
review of Sundance Coal Company's technical revision application for the
coal processing waste pile at the Animas underground coal mine. You will
recall that on August 2, 1983, I informed you that their technical
revision application was incomplete, because it lacked an analysis of the
potential subsidence effects of underground mining known by the operator
to exist beneath portions of the proposed waste pile expansion, as
required by Rule 2.05.3(8)(a)(i)(D).
Subsequent to issuance of that opinion, Sundance Coal Company
submitted a letter and attached map to the Division, in response to our
initial completeness comments. That lettei recognizes the necessity of
the required subsidence evaluation, but requests its deferral until
future planned underground mine working configuration decisions are
completed by the company. In their supplemental submittal the company
requests that permission be granted to place coal processing waste in a
restricted area delineated on the map attached to their supplemental
letter. This area does not include any of the areas potentially affected
by previbua known undermining. Therefore, this restricted area can be
considered without the subsidence evaluation required by Rule
2.05.3(8)(a)(i)(D).
For purposes of considering amendment of the coal processing waste
pile, limited to the two lower-most 50 foot thick terrace benches within
the restricted area delineated on the supplemental map, I now consider
the amended technical revision application complete. I have also
completed an adequacy review of the amended T.R. application, a summary
of which appears hereafter. With minimal editorial amendment, I believe
the following adequacy comments may also serve as findings for.your
eventual technical revision decision document.
Adequacy Review:
Sundance Coal Company previously obtained approval for construction
of a 1,000,000 cubic yard coal processing waste pile within the permit
