Materials Containment Plan Nothing herein contained shall be construed as allowing any discharge to waters of the State other than through the dischazge pt~ specifically authorized in this permit. Nothing herein contained shall be construed as excusing any liability the pemvttee have, civil or criminal, for any spill. The submittal of a Spill Prevention Control and Countermeasure Plan (SPCC Plan) as requved by 40 CFR Part 112 may satisfy all or part of this requuement. Should additional materials exist on site, which are not addressed in the SPCC Plan, addressing thos2`~ materials as per the above is required. . j/ If there is no such material present at the site, this shall be indicated in writing and submined to the Division for review. ~/ If there is inatcrial presrnt but the perminee feels ihett is not a reasonable probability of a spill affecting waters of the Stale, this shall be documrnted in writing and , submitted to the Division far review. This documentation shall include; 1) distance to nearest surface waters, and; 2) a detailed description of any stivetiirc which prohibits the release of marmot onto the Bound or into a conveyance system 2. STORMWATER REQUIREMENTS a. Stormwater Management Plan A current Stormwater Management Plan (SWMP) shall be maintained for the portions of the Eagle Mine.that aze covered by this section of the permit. The SWMP shall be prepared in accordance with good engineering practices. (The plan need not be completed by a registered engineer.) The plan shall identify potential sources of pollution (includiirg' sediment) which may reasonably be expected to affect the quality of stormwater discharges associated with the inactive mining operation. In addition, the plan shall descnbe and ensure the implementation of best management practice's' (BMPs) which will be used to reduce the pollutants in stoimwater dischazges associated with the.inactive mining operation and to assure coirrpliance with the terms and conditlons of this permit; RAG Empire must implement the provisions of their SWMP as a condition of this permit. The Division reserves the to review the plan, and to require additional measiues to prevent and control pollution as needed. SWMPs which met criteria contained in the previous version of this permit are acceptable. • Active Mining Areas The SWMP shall include the following items for active portions of the mine, at a rr,+r,;rra+*++• Description of Mining Activities The plan shall provide a narrative description of the mining and associated activities taking place at the site which affect or may affect stormwater runoff intended to be covered by this permit. The narrative description shall report the total acreage within the mine site and an estimate of the number of acres of disturbed area. A general description of the location of the mining site relative to major transportation routes and communities shall also be provided. 2. Area Subiect to Effluent Limitations Guidelines Each plan shall descnbe the portion of the training site which contnbutes runoff to areas subject to effluent limitations guidelines contained in 40 CFR subchapter N. 3. Site Ala Each plan shall provide a site map or maps which indicate at a m;,,;rr,~m• - mininglmilling site boundaries and access and haul roads; -equipment storage, fueling and maintenance azeas; - materials handling azeas; - areas used for storage of overburden, materials, soils or wastes; . - areas used for outdoor manufacturing, storage or disposal of materials; - location of mine diairiage or any other process water; - tailings pileslponds, both new and pre-existing;
