Materials Containment Plan <br />Nothing herein contained shall be construed as allowing any discharge to waters of the State other than through the dischazge pt~ <br />specifically authorized in this permit. Nothing herein contained shall be construed as excusing any liability the pemvttee <br />have, civil or criminal, for any spill. <br />The submittal of a Spill Prevention Control and Countermeasure Plan (SPCC Plan) as requved by 40 CFR Part 112 may satisfy all <br />or part of this requuement. Should additional materials exist on site, which are not addressed in the SPCC Plan, addressing thos2`~ <br />materials as per the above is required. . <br />j/ If there is no such material present at the site, this shall be indicated in writing and submined to the Division for review. <br />~/ If there is inatcrial presrnt but the perminee feels ihett is not a reasonable probability of a spill affecting waters of the Stale, this shall be documrnted in writing and , <br />submitted to the Division far review. This documentation shall include; 1) distance to nearest surface waters, and; 2) a detailed description of any stivetiirc which <br />prohibits the release of marmot onto the Bound or into a conveyance system <br />2. STORMWATER REQUIREMENTS <br />a. Stormwater Management Plan <br />A current Stormwater Management Plan (SWMP) shall be maintained for the portions of the Eagle Mine.that aze covered <br />by this section of the permit. The SWMP shall be prepared in accordance with good engineering practices. (The plan <br />need not be completed by a registered engineer.) The plan shall identify potential sources of pollution (includiirg' <br />sediment) which may reasonably be expected to affect the quality of stormwater discharges associated with the inactive <br />mining operation. In addition, the plan shall descnbe and ensure the implementation of best management practice's' <br />(BMPs) which will be used to reduce the pollutants in stoimwater dischazges associated with the.inactive mining operation <br />and to assure coirrpliance with the terms and conditlons of this permit; <br />RAG Empire must implement the provisions of their SWMP as a condition of this permit. The Division reserves the <br />to review the plan, and to require additional measiues to prevent and control pollution as needed. <br />SWMPs which met criteria contained in the previous version of this permit are acceptable. • <br />Active Mining Areas <br />The SWMP shall include the following items for active portions of the mine, at a rr,+r,;rra+*++• <br />Description of Mining Activities <br />The plan shall provide a narrative description of the mining and associated activities taking place at the site <br />which affect or may affect stormwater runoff intended to be covered by this permit. The narrative description <br />shall report the total acreage within the mine site and an estimate of the number of acres of disturbed area. A <br />general description of the location of the mining site relative to major transportation routes and communities shall <br />also be provided. <br />2. Area Subiect to Effluent Limitations Guidelines <br />Each plan shall descnbe the portion of the training site which contnbutes runoff to areas subject to effluent <br />limitations guidelines contained in 40 CFR subchapter N. <br />3. Site Ala <br />Each plan shall provide a site map or maps which indicate at a m;,,;rr,~m• <br />- mininglmilling site boundaries and access and haul roads; <br />-equipment storage, fueling and maintenance azeas; <br />- materials handling azeas; <br />- areas used for storage of overburden, materials, soils or wastes; . <br />- areas used for outdoor manufacturing, storage or disposal of materials; <br />- location of mine diairiage or any other process water; <br />- tailings pileslponds, both new and pre-existing; <br />
