Banta, <br />Division D~renor <br />Re: DeBeque Gravel Pit„ File M-81-058, Possible Temporary Cessation <br />Dear Mr. Latham: <br />We received and reviewed the DeBeque Gravel Pit Annual Report. The report <br />indicated that the site has been, and may continue to be, inactive for at least six <br />months. Please refer to the Minerals Rules and Regulations Sections 1.6.2 and <br />1.6.2(2)(a) which state that if an operation ceases production fora period of <br />180 days or more, the operator must file a Notice of Temporary Cessation with the <br />Board. This notice must. state the date of cessation, the reasons for cessation, a <br />plan for the resumption of mining, a description of those activities the operator <br />will take to ensure compliance with the permit reclamation requirements and a <br />description of site mair~tenance activities to ensure compliance with the <br />performance standards (A:ule 6). The Notice of Temporary Cessation should be sent <br />to the Division separates from other correspondence. <br />As an alternative to tertfporary cessation, you may amend your permit to indicate <br />that the operation will be intermittently active throughout its life. The <br />amendment application must include a description of those activities the operator <br />will undertake to ensure compliance with the permit reclamation requirements, and <br />description of the site maintenance activities which will ensure compliance with <br />the performance standards (Rule 6). Rule 1.6.2.(2)(d) addresses this amendment. <br />Since the annual report indicated that operations have temporarily ceased, you <br />should submit either a request for temporary cessation or a permit amendment within <br />the next 45 days. If the request indicates that the site is sufficiently <br />stabilized, we will approve the request for cessation within sixty days. If the <br />request indicates that there may be same problems with the site, we will either <br />request more informatior~ from you, or schedule the site for an inspection. If you <br />submit an amendment to t:he permit, we will process it within 30 to 90 days for 110 <br />and 112 operations, respectively. <br />If you have questions, please do not hesitate to call. <br />Sincerely, <br />Barbara D.
