4 <br />Summary <br />In my opinion, Gregg Squire exercised an allowable flexibility in monitoring Moffat <br />County's Annual Report inclusions: <br />• Moffat County is not a security risk; <br />• We have never been sued in issues related to our Mined Land Reclamation <br />Permits; <br />• The Division of Minerals and Geology has never been sued for pemutting <br />a liability risk on our facilities; <br />• Our annual renewal fees for 18 gravel pits are running over $9000 per <br />yeaz. <br />• Our gravel pits are easy to monitor and process; <br />• There is very little "new disturbance" from yeaz to year; <br />• Moffat County is committed to the environmental quality of our <br />reclamation; - <br />• We have reclaimed several dozen gravel pits in the past 20 years -without <br />an environmental failure or a complaint; <br />We have worked closely with your staff. For example, when Barbara Chiappone <br />called me to report that most of Moffat County's original files had been ruined by water <br />damage in the DMG file room, I sent her copies of every thing I had from our files. And <br />when the Mined Land Reclamation Board was certain that only the State Archaeologist <br />could issue Mined Land Reclamation permits, it was Moffat County that led everyone out <br />of that swamp. <br />Conclusion <br />I am requesting that the Division of Minerals and Geology continue to accept Gregg <br />Squire's abbreviated "report", and the mapping protocol, as I have filed them -and the <br />"Division" has accepted them - for the past decade under Rule 1.15 (2). <br />Respectfully submitted by: <br />Marvin Moore (Consultant) G <br />1570 Ranney, Craig, CO 81625 <br />(970)824-9249 <br />~ w <br />
