<br />GCC Rio Grande also obtained a permit to dischazge storm water runoff from two <br />outfalls that aze associated with the property during construction of the Portland cement <br />manufacturing facility. Part I,B. of the permit requires monitoring of storm water discharges <br />from those two outfalls for several parameters including pH, Total Suspended Solids, Oi] and <br />Grease, and Discharge Flowrate. Part LB. also requires that the analytical results of this <br />monitoring be submitted to the Colorado Department of Public Health and Environment within <br />30 days of the end of each calendar quarter. Since the Commission's September, 2004 review of <br />GCC Rio Grande's Special Use Permit the following monitoring reports have been submitted to <br />the CDPHE: <br />Submittal Date Calendar Quarter <br />October 11, 2004 3rd Calendar Quarter, 2004 <br />January 18, 2005 4th Calendaz Quarter, 2004 <br />April 28, 2005 IS` Calendaz Quarter, 2005 <br />July 14, 2005 2~ Calendaz Quarter, 2005 <br />At present, there have been no discharges associated with industrial activity. <br />Subsequently, the monitoring reports indicated above reflect a "1`Io Discharge" status. GCC Rio <br />Grande paid the annual fees on the stormwater permit for construction of the facility on July 29, <br />2005. <br />c. State Land Board Approvals: GCC Rio Grande continues to maintain its <br />"good standing" under the terms of its lease with the State Land Boazd. GCC Rio Grande has <br />done this, in part, by maintaining its payments of lease payments and mineral royalties to the <br />Board of Land Commissioners and by complying with all applicable provisions of the lease. <br />d. BLM Minin Claims: GCC Rio Grande continues to maintain its BLM <br />mining claims by paying the annual fees associated with each claim. GCC Rio Grande paid <br />these fees on July 20, 2005. <br />e. Division of Minerals and Geology. Mined Land Reclamation Board <br />Reclamation Permit: By this submittal, GCC Rio Grande has made its annual fee payment and <br />filed its annual report. <br />(1) Over the past two yeazs, GCC Rio Grande has been negotiating <br />with the DMG a proposal for posting a reclamation bond for the facility which included an <br />escrow agreement as authorized by the MLRB Rules and Regulations. DMG had not previously <br />used an escrow agreement for a reclamation bond, and therefore had to develop and obtain <br />MLRB approval of a new form. With the assistance of GCC Rio Grande, the DMG developed a <br />new escrow agreement form and escrow financial warranty form for statewide use in bonding For <br />reclamation of mining operations. The escrow forms were unanimously approved by the MLRB <br />on August 20, 2003, and GCC submitted completed escrow forms to the DMG on August 22, <br />2003. GCC Rio Grande has transferred funds into the escrow account in order to secure the <br />MLRB reclamation fund. <br />DN:32I09860.1 <br />
