I forward the following comments for your consideration. <br />(1) The proposed design revisions are appropriate and I recomr.~end your approval <br />of the proposed redesign. <br />(2) The reference to the stability analysis performed in the original coal <br />processing waste pile design is acceptable, because the heighr and slope angle <br />of the pile have not changed significantly, rather the pile merely increases <br />its surface area. <br />(3) Based upon Empire's past performance, I strongly recommenc9 that our approval <br />directly reference the inspection and certification requirements of Rule 4.10.2,' <br />with which this coal processing waste pile must conform. <br />(4) Z further encourage you to place this particular facility high in your <br />enforcement priorities. <br />(S) I have referred the minor revision application to Roy Cox for an opinion re- <br />garding the applicant's request for waiver of the normal 9 foot non-toxic cover <br />requirement. <br />(6) I have referred the minor revision application to Jerry Z.impfer for a review <br />of the surface Hydrology aspects contained therein. <br />/mab <br />cc: Roy Cox <br />Jerry Zimpfer <br />
