<br />Dear Mr. Abraham:
<br />You had previously submitted a CDPS tiischazge permit application for the above referenced facility, to the Water
<br />Quality Control Division (WQCD), Colorado Deparvnent of Public Health and Environment, for the Golden
<br />Wonder Mire which was received at the Division on September 15, 1994. This facility is located approximately
<br />2.5 miles southeast of Lake City in Hinsdale County, Colorado.
<br />In a previous letter regaztiing this site from the WQCD to you, which was dated September 5, 1997, the Division
<br />indicated that we had determined that you will need to demonstrate compliance with certain permit limitations
<br />which are based upon federal efFluem guidelines and which were to have been effective immediately upon the date
<br />of permit issuance. In response to this letter, we received a letter from a new operator for the Golden Wonder
<br />Mine, Au Mining, on 10-20-97 which stated that they wanted to withdraw this discharge permit application. I
<br />referred this on to Marla Bibersdre in our Division, and Marla called you to request a withdrawal letter from LKA
<br />International, Inc. Based on no letter being received from LKA International Inc. for withdrawal of this permit
<br />application, no response on several issues from LKA International, as well as the dischazge not being able to
<br />comply with the proposed permit limitations for the discharge if this were to go to surface waters (which includes
<br />dry tributaries), the WQCD is denying this permit application. This notification was sent to you as part of the
<br />public notice on February 6, 1998. The application will be denied effective March 9, 1998.
