Long <br />Division Director <br />I would like to request that Jim Pendleton review the attached <br />report to verify that the information is sufficient to comply with <br />the approved plan, and that observed effects are in accordance with <br />projections. The monitoring plan is described on Page 239 of the <br />application, a copy of which I have included. The report is <br />limited to visual surface inspection, as the Roadside North <br />subsidence monuments have apparently not yet been undermined (it <br />would appear that SMO1 will be undermined this year). <br />I have also attached copies of pages 224 and 225 from the <br />application. These pages describe a recently constructed residence <br />and irrigation structures which were constructed over mined out and <br />active mining areas of the Roadside South Mine. What obligations <br />does the company (and DMG) have with respect to such structures <br />which were built after the permit was approved, and to a large <br />extent, after mining had been completed in the area? Also, the <br />annual report on Page 3 mentions a high voltage powerline in a <br />portion of the Roadside South area to be mined in the near future <br />(apparently the 6 East Panel in the vicinity of Rapid Creek). This <br />power line is apparently not depicted on the "Man Made Features Map <br />(Exhibit 46), and the report states the "powerline was installed <br />subsequent to coal lease and was installed with the understanding <br />that mining could subside the line." Does this facility need to be <br />addressed within the subsidence survey/mitigation portions of the <br />application? <br />rside\95subrep.mem <br />
