Manb 2002 H-G Coal Company * 2001 Annual Ra/amation and Hydrology Report ~ 3-2 <br />3.3 SEDIMENT POND MONITORING <br />As indicated above in Section 3.1, the CDMG approved cessation of sampling the sediment ponds. <br />Pazt of their technical basis was, "that Sedimentation Ponds 003 and HG-8 are no !anger part of a mine <br />sediment control plan, but are 7vatenng ponds far vnldlife and livestock.." <br />3.4 QUARTERLY POND INSPECTIONS <br />As the above statement indicates, ponds 003 and HG-8 are know watering ponds for wildlife and <br />livestock. The CDMG rescinded jurisdiction over the ponds in a letter dated August 18, 1999. A <br />copy of the CDMG's August 18, 1999 letter is presented in Exhibit 4. Consequently, HGCC no <br />longer has to inspect the ponds, and there were no inspection events during calendar year 2000. <br />3.5 CDPS DISCHARGE MONITORING <br />In response to the CDMG's finding that Sediment Ponds 003 and HG-8 wexe no longer pazt of a <br />mine sediment control system, but were watering ponds for wildlife and livestock, HGCC submitted a <br />request to the CDPHE to de-activate the CDPS permit (COG-850018). HGCC submitted the Permit <br />Termination Form to the Colorado Water Quality Control Division on September 10, 1999. The <br />Water Quality Control Division approved the termination request in a letter to HGCC dated October <br />29, 1999. The termination approval is presented in Exhibit 2. Consequently, HGCC no longer <br />monitors dischazge from the ponds, and there were no monitoring events during calendaz year 2001. <br />MlVH * BO.
