ALBERT FRET AND SONS, INC. <br />WORTHING SUBDIVISION <br />CASE # 55-76-ZP <br />INTRODUCTION <br />This amendment is to Adams County Case Number 55-76-ZP, a Condi- <br />tional Use Permit for mining sand and gravel. This amendment will not <br />change the intended final use as a private lake area. Below we have <br />addressed the compatibility questions in the Zoning Resolution and <br />explained the request. we filed a Technical Revision with the Divi- <br />sion of Minerals and Geology to allow for dewatering and received the <br />approval on November 28, 2000. The information has been incorporated <br />in this amendment. This packet contains information on our proposed <br />minor changes to the operations and reclamation plan. These changes <br />make the county permit consistent with the state permit as it has <br />evolved over the last twenty-two years. <br />Our request is quite simple, and we go into the details later in <br />this document to support our request. First, we need to dewater the <br />lake area to more efficiently operate it. Dewatering will allow us <br />access to the bottom of the lake where we can find out whether addi- <br />tional gravel lies under a shale layer similar to what we have found <br />in other operation along the South Platte River. Second, some shale <br />will be used during the construction E-470 to fill areas of the ROW <br />from SH 85 to the river. Some of the shale will be used to fill the <br />northeast corner of this site so it is at the same grade as Brighton <br />Road. Since dewatering opens the lake of evaluation in may be feasi- <br />ble to construct a water storage reservoir by lining the banks, build <br />a slurry wall around it or a combination of both. If during <br />dewatering we find it is feasible to make a reservoir we will have the <br />necessary engineering work done and begin construction. <br />Please refer to the Mining Plan and Reclamation Plan sections of <br />this submittal for the details on how the project will be developed. <br />Because we will not have an exact idea of how much material is left in <br />the mined area until dewatering is complete we are not able to develop <br />a firm time schedule at this time. Once we have the lake dewatered we <br />can analyze those variables and either continue to mine the new <br />reserves and construct the liner or complete mining, shale removal, <br />grade the slopes into the lake and let the lake refill with water. <br />The dewatering is the most important part of this permit change. <br />We have included the detailed analysis of its impact on surrounding <br />properties, prepared for our Mined Land Reclamation Board permit. The <br />analysis of this finding starts on page 11 under the Water heading. <br />The following list contains the necessary permits, permit numbers, <br />their status and comments to dewater the mine. <br />D.M.G.
