The third quarter inspection was completed on <br />21 September 2005 and the forth quarter inspection was completed on 2 November 2005. <br />Both reports state that no overburden was hauled from the West Pit Fill in either quarter. <br />The report also stated that no springs or seeps were noticed, there was no pile movement <br />(a maximum of 0.07") and there was no structural weakness or other hazardous <br />conditions associated with the fill. <br />The Division does have one question, however, regarding the West Pit fill and associated <br />inspection reports. <br />1. Both the third and forth quarter 2005 reports indicate that the ditch at the <br />7,250' elevation needs to be completed at the west end of the fill. This same <br />statement appears in every report dating back to at least the first quarter 2004. <br />Please provide the Division an explanation as to why this ditch has not been <br />completed and an anticipated schedule for its completion. <br />Please contact me if you have any questions or concerns at (303) 866-4929. <br />Sincerely, <br />James R.
