9.01 Within thirty (30) days after execution of this Lease, FCM will provide a <br />reclamation bond to Colorado Division of Minerals and Geology to replace the existing bond. <br />During the term of this Lease, FCM shall provide its labor, services and materials for <br />reclamation work to be performed at the Gravel Pit. All reclamation work performed by FCM <br />shall be performed in accordance with the terms of the Gravel Permit, as amended or modified <br />and Trenkle hereby authorizes FCM to complete all required reclamation work as required by the <br />Colorado Division of Minerals and Geology. <br />- 9.02 Reclamation. FCM shall complete the reclamation at the Gravel Pit required by <br />the Colorado Division of Minerals and Geology pursuant to the terms of the Gravel Permit, as <br />amended, and in no event later than one (1) year after this Lease Agreement terminates. <br />Section 10. NOTICES <br />10.01 Notice to FCM. Any notices required under this Lease to be given by Trenkle to <br />FCM shall be sent by first class mail or by telefacsimile followed by first class mail to: <br />Attn: Victor A. Any notices required under this Lease to be given by FCM to <br />Trenkle shall be sent by first class mail or by telefacsimile followed by first class mail to: <br />Attn: Dale L. Trenkle, President <br />High Flume Gravel Pit, Inc. <br />350 High Flume Loop <br />Durango, CO 81303 <br />10.03 Chanee of Notice. Should either party desire to change the party designated to <br />receive notice or the address to telefacsimile number where notice should be sent under this <br />Lease Agreement said change shall be accomplished by written directions sent to the other party <br />by registered or certified mail. <br />Section 11. INDEMNIFICATION <br />11.01 Trenkle Indemnified. FCM hereby agrees to hold Trenkle harmless and to <br />indemnify Trenkle from any and all losses attributed to FCM's activities contemplated under this <br />Lease Agreement or from other activities reasonably incident thereto undertaken or occurring on <br />or at the Gravel Pit. <br />High Flume Pit Lease <br />12/23!02 <br />Page 5 of 7 <br />
