Section 25-8-501(1) of the <br />Water Quality Control Act requires that a permit be obtained for discharges into state waters. Inspections <br />by both the Division of Minerals and Geology and this Division on two separate occasions have revealed <br />that a discharge permit is necessary. Therefore, the Division is requesting that the attached permit <br />application be completed and submitted within sixty days of receipt of this letter as required in Part <br />6.5.1(1) of the Regulations for the Discharge Permit System. Failure to apply for and obtain coverage <br />under the necessary permit(s) may result in enforcement action by this Division. Such enforcement action <br />carries a civil penalty of up to $10,000 per day. <br />Should you feel that a permit is not required, please submit your explanation to support this determination <br />along with the completed application.
