<br />2. assess whether that is material damage, <br />3. determine whether the potentially damaged power lines can <br />be readily repaired (based on the utililty's testimony), <br />4. obtain an assessment from the power company as to whether <br />off-site impact would occur in the event of damage to the <br />power line. <br />Houses. and irrigated lands <br />Second, the Scroggins house and shop building referenced on <br />recently revised pages 224 and 225 of the permit application should <br />also be depicted on Exhibit 46, along with the irrigation ditches <br />on the Powder Mountain Ranch surface described on Page 225. The <br />"limited irrigation" on Powder Mountain Ranch surface should be <br />more fully described, and any irrigated cropland or pastureland <br />which would constitute renewable resource lands pursuant to Rule <br />1.04(110) will need to be mapped as required by Rule <br />2.05.6(a)(ii)(B). <br />In general, the potential effects of subsidence on the newly <br />identified structures and renewable resource lands will need to be <br />assessed, pursuant to Rule 2.05.6(6)(b), and the approved <br />subsidence survey and/or subsidence control plans will need to be <br />modified as appropriate, to demonstrate that no material damage or <br />diminution of reasonably foreseeable use could result. For <br />structures recently constructed on previously mined areas, the <br />application will need to be amended to address how any material <br />damage or diminution of reasonably foreseeable use will be <br />mitigated, if it were to occur. An inspection of the current <br />structural condition of the house and shop buildings would be <br />advisable. <br />We will request that these concerns be addressed within the context <br />of the mid-term review response revision application to be <br />submitted this month.
