Waters from Lion Creek anter La Sal Creek, a Tributary to the Dolores <br /> River. Sediments line the stream Lank and the irrigation channels through private <br /> property across highway 90. <br /> ---------------------------------------------------------------------------------- <br /> Saint Patrick mine owner, Mike Moora, (303)-864-7814) returned my call on September <br /> 19th. I told him that Schreiner and I had inspected his mine on the 14th and noted <br /> there were storm water run of concerns and the vegetative cover was patchy. He said <br /> he would call Tom and find out more and share with Tom the fact that he did not feel <br /> that he was responsible for natural forces of storm events. <br /> 09/23/94 Mike Moore called at 8 am to discuss St. Patrick Mine erosion control. <br /> Mike stated that small mines were Developed to supply Vanadium/Uranium to the <br /> federal government, and for folks who ended up with the mine sites after the Uranium <br /> Boom often were individual, like himself, who had received no financial gain at all <br /> from their association with the mining activity. In Mike's case he closed the mine <br /> portal and site because he felt that it was the responsible thing to do after the <br /> death of rr. Bunker. He said the Lanch only became a road after mine waste had been <br /> dumped over the bank in significant enough amount to warrant coming in with a cat <br /> and developing a driving surface. He felt that it would be unfair for the BLM to <br /> require the removal of the mine waste pile down to the pre-mining surface in order <br /> to enhance revegetation. <br /> He said when he had walked into the mine site this spring , seed from the <br /> revegetation mixture he had planteu in the fall, of 1993 had germinated and seedlings <br /> were established. Following a extended period of drought, he revisited the Bite and <br /> noted that grass and clover had not survived except in isolated patches (for <br /> example, directly adjacent to the portal closure). He preceived the BLM should have <br /> gotten back with him sooner if we wore not satisfied with the work he had done and <br /> should have alerted him to the fact that we were concerned that the mine waste pile <br /> and storm water run off from the permitted area were contributing to sediment <br /> movement in Lion Canyon. <br /> I tried to convey that we hope that small-mine closures will provided the site with <br /> adequate capability to withstand storm events and prevent the movement of materials <br /> from the waste dumps and arest sloughing of adjacent materials. We recognise that <br /> unlimited funds are not available to do the kind of reclamation work that would <br /> assure the public that the entire permitted area is stable and predictable. <br /> Mr.Moore asked how long he would be responsible for the Saint Patrick mine, and <br /> would he be continually expected to work against water erosion regardless of his <br /> good faith effort to close the mine. He wondered, if he did more earthwork on the <br /> site this year, and planted seed tha second time, would the BLH be willing to write <br /> a letter of release from liability before he started the excavation work. 1 don't <br /> have the authority to make a decision like that, and all I could tell him was that <br /> we would sincerely appreciate his effort. <br /> He isn't willing to haul in material to serve as an armored berm around the rim of <br /> the waste pile, and could see no logical way that he could divert storm water off <br /> the hill in a controlled manner without excessive expenditures. He refused to <br /> divert storm water into the spring area due to the potential of mixing spring waters <br /> with storm run off water, or disrupting additional structural material. <br /> Mr. Moore said he had photodocumentation regarding seeding activities and efforts <br /> and had a copy of our August 10, 1993 letter to Mr. Stevens of Colorado Division of <br /> Minerals and Geology stating that hie 1993 reclamation activities for the St. <br /> Patrick Mine, Permit CDMG (M-77-446) met or exceed the BLM's standard. His position <br /> is that he is willing to work on tha project one more time and that is all. He is <br /> emphatic that it is not his responaibility to maintain the Lion Canyon Road. <br />
