Mined Land <br />Reclamation (Office) that Energy Fuels Nuclear, Inc. (EFNI) does <br />not agree that the West Sunday Mina is a Designated Mining <br />Operation (DMO). EFNI disputes the designation !or the following <br />reasons: <br />1. The West Sundlsy Mine operation does not meet the criteria for <br />designation provided in Rula 1 of the Mineral Rules and <br />Regulations o! the Colorado Mined Land Reclamation Board, as <br />amended in April, 1994 (Rule 1). , <br />2. The criterion given in the letter, which was applied to <br />determine that the West Sunday Mina would ba a DMO, is not one <br />of,thoae list~ad in Rule 1. <br />3. Reclamation activities carried out concurrent with mining <br />operations, and stormwater management measures ensure that no <br />toxic or acid-forming materials are exposed or disturbed in <br />quantities sufficient to adversely affect human health, <br />property, or ~:he environment. <br />
