Please let me
know if you need anything further in this regard.
Also enclosed is a copy of a letter from Eagle County in
February of 1979 which should already be a part of your file
on the Avon pit. I had forgotten that the boundaries of the
grandfathered pit area had been so clearly delineated at the
time the issue was originally resolved. The discussions at
that time centered around the fact that gravel pits by their
very nature are progressive operations and that all areas
are not mined at one time. The entire area included in the
description in the County' s 1979 area was not at that time
included in the Mined Land Board permit for financial reasons.
However, I do not believe that the expansion of the permitted
area now so far as the Mined Land Board is concerned is an
expansion of the grandfathered pit area for County purposes.
I have written to Susie Vaughn and sent her a copy of the
letter in case it has also become buried deep in County
files, and we are awaiting some response from her.
I will be out of town the week of March 5 through 12 , but
will probably be in touch with you again shortly after I
return. In the meantime , if something serious should come
up, please contact George Petre in this office.
Thanks for your help.
Very truly yours ,
PETRE & ZIMMERMAN P.C.
Courtney G.
