bind themselves, and each of their legal representatives, executors, <br />administrators, successors and assigns, jointly and severally, firmly by these <br />presents. <br />WHEREAS, the Principal has applied for a Radioactive Materials <br />license (the "License") from the Division to crush, wash and sort uranium ore, <br />and to store and transport crushed or sorted uranium ore and radioactive <br />residues and waste materials from the Schwartzwalder Mine, on land iii <br />Jefferson County, Colorado (hereinafter referred to as the "Project Area") <br />described in exhibit A attached hereto. <br />WHEREAS the Department has required the Principal to <br />decommission, decontaminate and reclaim the Project Area. <br />WHEREAS, 6 CCR 1007-1-3.9.4 requires that, as a condition of the <br />License, and as a condition of any amendment or renewal of the Licen:oe, the <br />Principal is required to furnish a financial surety arrangement to ensure the <br />decontamination and decommissioning of the Project Area for the protection of <br />the public health and safety in the event of abandonment, default, or <br />inability of the Principal to meet the requirements of the Colorado Eadiation <br />Control Act, C.R.S. (1973 and Supp. 1981) 25-11-101 et seq. or as amended <br />(the "Act"), the regulations promulgated thereunder, and the License. <br />-36- <br />
