I am a professional engineer registered in the State of Colorado and my experience fulfills the requirements of Colorado Surface Coal Mining Reclamation Act. The purpose of my inspection and certification was to ensure proper construction of the refuse pile and to satisfy the require- ments of Rule 4.09 1(11) of the Colorado Mined Land Reclamation Board. In completing my certification, I have conducted an inspection of the refuse sub-area 1 pile and construction site. There are no apparent points of seepage in the pile, and there is no indication of slope failure. The surface drainage facilities were adequately maintained and were working properly. No sub- drain system is required by our permit, since geotechnical inves- tigation for the disposal site revealed no ground water present. Permanent out slopes have not yet begun to be built. We are currently constructing our first lift with the horizontal layering. We are currently renting two types of vibratory sheeps- foot compactors in order to determine the most efficient design to be purchased. We found it necessary to rent two additional caterpillar tractors (D-8) over the past 30 days in order to spread and dry material down to optimum moisture content.
