The Division recommends that all mine operators <br /> check compliance of their operation(s) with State Water Law. If <br /> mining commences without prior compliance with applicable State <br /> Water Laws, the State Engineer may take enforcement action. <br /> IV. Exhibit E - Reclamation Plan <br /> 1 . The reclamation plan as proposed in this amendment appears to limit, <br /> delete and qualify portions of the existing plan which was developed <br /> by the Land Design Partnership. The existing reclamation plan as <br /> was approved as a technical revision will stand unless the applicant <br /> provides sufficient justification to the Division' s satisfaction <br /> that specific changes will enhance the possibility of achieving <br /> reclamation success. <br /> 2. The Division is concerned about the final topography as it relates <br /> to drainages which cross the permit area. These points of inflow <br /> into the permit area should be shown on one of the application <br /> maps. Furthermore, the applicant should show what measures will be <br /> instituted to prevent erosion at these spots after revegetation has <br /> taken place. <br /> 3. The amount and type of fertilizer will need to be determined at the <br /> time of topsoil reapplication. For both on-site and imported soils <br /> the following analyses will be needed: nitrogen, potassium and <br /> phosphate as P05. <br /> V. Exhibit L - Reclamation Costs <br /> 1 . The operator has proposed that there will be no phased reclamation <br /> and no reclamation be instituted until all mining has been completed <br /> in the western portion of the permit area. The bond and amount must <br /> be recalculated to include the total cost for reclamation of the <br /> site. <br /> The amount of financial warranty is based on the estimated cost to <br /> the Division should the permittee abandon the site and outside <br /> contractors were hired by the Division to complete the reclamation <br /> plan. It is the Division' s opinion that the reclamation costs as <br /> estimated by Nottingham Sand and Gravel in Exhibit L are <br /> insufficient. <br /> 2. The reclamation cost calculation must include the cost for <br /> importation of topsoil and for importation of fill to level the <br /> settling pond.
