Drawer 400 <br /> Glenwood Springs, Colorado 81602 <br /> RE: Nottingham Sand and Gravel - Eagle Pit, File No. 78-352 <br /> Dear Mrs. Petre: <br /> The Division has reviewed the Eagle Pit amendment application to determine if <br /> it adequately addresses the requirements of Rule 2 and 6 of the Regulations. <br /> The following questions and comments regarding the adequacy of the application <br /> must be addressed at least five days prior to the May 23-24, 1984 meeting of <br /> the Board. <br /> I. General Information <br /> 1. In conformance with Rule 1 . 56(5) , please supply agreements with the <br /> persons who have interests in the man-made structures within 200 <br /> feet of the permit area. These agreements must state that any <br /> damage to the structure is to be compensated for by the operator. <br /> For the Eagle Pit those structures include: <br /> a) Denver and Rio Grande Western Railroad; <br /> b) U.S. Highway 6 and 24; <br /> c) Telephone lines; <br /> d) Power lines, and <br /> e) The Streeme and Gates irrigation ditch and wells. <br /> II. Exhibit A - Legal Description <br /> 1 . All affected lands defined in C.R.S. 34-32-103(1) must be included <br /> within the area to be permitted. Therefore in the case of the Eagle <br /> Pit, the access roads into the pit must also be included within the <br /> permit area.
