D U M <br />(~NOVember 1981 <br />TO: Sandy Emrich ~ <br />FROA1: Jim Pendleton ~ <br />RE: Draft Finding Regar ing Tne Eagle No. 5 6 1JO. 9 Coal Mines <br />Pursuant to your request I forward the attached draft findings for <br />Sections XXIII, XXII and XXIII of your findings document :`or Empire Energy <br />Corporations' Eagle P1ine Complex. <br />Section XVIII, "Coal Processing Flaste ...", assumes that a stipulation <br />regarding the required thickness of non-toxic cover material will be <br />included within the gorund water portion of your findings. I have included <br />a reference to such a stipulation within my draft findin_q for t3~e coal <br />processing waste pile. You will have to insert the appropriate reference <br />where I have left a blank. <br />Section XXII, "Sealing of Drilled Holes and Underground Openings", <br />finds compliance and includes no imposition of stipulations. <br />Section XXIII, "Subsidence", finds compliance and includes no <br />imposition of stipulations. However, this finding assumes that those clerical <br />items refered to in my memo to you of October 20, 1981 have been complied <br />with by the applicant.
