Y~1 ` <br />REQUEBT FOR VARIANCE <br />FROM APPRORIMATE ORIGINAL CONTOUR <br />CARBON JUNCTION MINE <br />JANUARY, 1993 <br />Set forth below are responses to Rule 4.27.4 of the Colorado <br />Mined Land Reclamation Division for a variance from the original <br />contour on an area described in the following. This request for <br />variance has been formatted to follow the requirements of Rule <br />4.27.4. <br />(1) There is no true or classic highwall to be involved with <br />the proposed variance. The area covered in the variance <br />has been shown on the attacted Exhibit A. As can be seen <br />from this exhibit, the subject area includes a "dip- <br />slope" to be mined early in the life of the project. <br />Approximately 40 feet of overburden lies over a coal seam <br />that is 30 feet thick. The slope and the thickness of the <br />overburden has been shown on Exhibit B. The overburden <br />will be removed and permanently stored in the fill area. <br />After the coal is extracted, the reminent footwall will <br />be a solid rock bench with a slope of 57$. Because of <br />the steep slope, it will be impossible to replace the <br />overburden on the slope and insure stability. <br />Consequently, a standard geotechnical analysis of the <br />area will not be applicable. The footwall is a solid <br />rock ledge sitting on a 57$ slope. <br />(2) The watershed control will flow into the normal sediment <br />control system. As can be seen from Map 5-1, the <br />sediment will flow into Sediment Pond P2. No variance in <br />the hydrologic control system will be necessary. See Map <br />5-1 for design of the sediment control system. <br />(3) No land will be disturbed above the footwall. No <br />blending will be necessary in the final reclamation. <br />There will be no temporary storage of overburden. <br />(4) With this application the operator is requesting the <br />variance. <br />(5) All operations will be conducted in compliance with the <br />provisions of Rule 2.06.5. <br />(6) No spoil will be returned to the variance area, which <br />will be reclaimed in accordance with the approved plan. <br />
