Based on your response I feel it may be beneficial to elaborate on <br />our position related to subsidence phenomenon at the Foidel Creek Mine. <br />As you are well aware, TCC has two rather important revisions currently being <br />reviewed by the Division. Part of the review associated with those revisions <br />requires analysis of the subsidence data that exists to-date. Accurate, <br />consice, and up-to-date subsidence monitoring data is absolutely essential for <br />a complete and thorough review by the Division. At a minimum the Division <br />insists that subsidence reports, including maps, meet all requirements of the <br />Rules as well as any criteria required by your approved permit. In addition, <br />there may be information, maps, dates, data, etc. that the Division may feel <br />would assist us during our review and it is our opinion, based on past <br />experience, that TCC will provide that information when it is requested. <br />Currently, there is no accurate and straight-Toward way for Division personnel <br />to actively monitor subsidence due to confusion on timing, advance, trailing <br />subsidence, longwall position, etc. Hence, the request to provide maps which <br />accurately relate the surface to the underground operation. In addition, <br />given the features which may be undermined in the future, we feel it is <br />absolutely reasonable to request an approximate advance of the longwall for <br />the following 6 months. <br />
