Amendment Applications for: <br /> Eagle Pit - Permit No. 78-352 and <br /> Avon Pit - Permit No. 77-343 <br /> Dear Jim: <br /> I cannot tell you how relieved I am to get these amendment <br /> applications in to you. Please believe me when I tell you <br /> that we have all been working for more than a year to get <br /> everything on these two pits straight and clear. Since that <br /> has been the case, I anticipate that you or Peter O' Connor, <br /> or whatever staff member works on these matters, will perhaps <br /> have a number of questions. Both Bill and Randy Nottingham <br /> feel that those questions could be eliminated or much more <br /> easily answered if a member of the MLRB staff could come out <br /> and walk the pits with Randy or Bill Nottingham and me. I <br /> realize that the middle of winter is not an ideal time for <br /> doing that; therefore, I imagine that the Board' s meeting in <br /> April will perhaps be the earliest reasonable time for <br /> formal consideration of the amendment requests. Please give <br /> me your thoughts about this timing and the possibility of <br /> everybody getting together at the pit sites. <br /> I have two mechanical questions to ask you in regard to <br /> these amendment applications. First, I am assuming that <br /> they are not "filed" until I have a letter from you desig- <br /> nating a filing date, and therefore I have not yet sent copies <br /> to Eagle County. Please let me know if those copies should <br /> go immediately. Second, the Avon Pit area is completely <br /> inside property owned by the Nottinghams and touches no <br /> other property except for Interstate 70 on the north. Is <br /> the Highway Department an "immediately adjacent owner" for <br /> these purposes, and should they get a mailed notice of the <br /> publication on the Avon Pit application? <br />
