Further all of the <br />information required by the CMLRB regulations is contained on the <br />maps. <br />It is my opinion that you are requiring Walden Coal to <br />submit documents, not maps, which contain information about the <br />post mining topography and the post mining drainage plan. The <br />CMLRD has been provided with a certified post mining <br />topographical map. You are requesting that someone author a <br />statement concerning whether the post mining topography as built <br />and post mining topography as"approved are consistent. I find no <br />regulatory support for requesting such a statement or <br />certification. Moreover the CMLRD has gone to the expense and <br />effort of surveying the Bourg property and should know that the <br />planned and as built post mining topography are comparable. <br />The second certification you have requested is for the <br />"drainage" plan of the Bourg property. I have two concerns with <br />this request. First, I find no regulatory support that a <br />"drainage" plan be certified. Walden Coal's sediment control <br />plan contains no engineered structures, such as dams or ponds, <br />which do require certification. Second, at no time in the long, <br />tedious process of reviewing and approving the sediment control <br />plan for the Bourg property did the CMLRD inform or advise Walden <br />
