Lang <br />Division Director <br />Rule 4.09.1(1 1)(a) The fill shall be inspected for stability by a registered engineer or other <br />qualified professional specialist experienced in construction of earth and rockfill embankments <br />rutder the direction of a qualified professional engineer rat least yuarterlyl throughout the <br />construction ar:d during the following critical construction periods'": (/)removal of all organic <br />material and topsoil, (2)placement of underdrainage systems, (3) installation of surface drainage <br />systems, (4) placement and compaction of fill materials, and (5) revegetation. <br />The petmittee is in compliance with this rule. I This is a quarterly report. A registered engineer <br />accomplished both the inspection and certification. 'None of the critical construction periods <br />were encountered during the time period of the report. <br />Rule 4.09.10 l)(b) T/:e qua/ified registered engineer shat/ provide to the Division a certified <br />report within 2 weeks rafter each inspection I that dre fill has been constructed ns specified in the <br />design approved by the Division. 'The report shall include n description of arty appearances of <br />instability, structural weakness, aad other hazardous conditions observed during the inspectiat. <br />A copy of t)re report shall be retained rat t)re mine site. <br />This report was apparently lost in the mail. Upon request, a copy of the report was submitted to <br />the Division and received on March 2, 2001. 'The report is not in compliance with this portion <br />of this rule. The 4'h quarter inspection was reported as accomplished on December 28, 2000, and <br />was certified on January 23, 2001. Thus the report was certified over 3 weeks after the date of <br />inspection. The requirement of this rule is brought to the attention of the permit[ee (as stated <br />above, none of the critical activities were engaged during the reporting period). 2 The report <br />addressed the required topics. <br />Rule 4.14.3(1)(a) A person who conducts surface coral mining operations shall insure that al/ <br />debris, acid fonning materials, taric materials or materials constituting a fire )razard are treated <br />or brtried acrd compacted or otherwise disposed of in a mmrner approved by the Division and are <br />
