Box 229 <br />Boulder, CO 80306 <br />Re: Bond Release Submittal, Certifications, Bourg Mine, C-81-021 <br />Dear Mr. Patten: <br />I would like to take this opportunity to respond to the two issues raised in <br />your September 11, 1989 correspondence regarding certification. You suggest <br />that there is no regulatory basis for our request for the submittal of <br />certified as-builts and that the Division retroactively is imposing these <br />requirements on Walden Coal. The Division differs with you on both counts. <br />Rule 4.05.6(7) requires that sediment ponds be certified. Walden Coal Co., <br />however, received a variance from use of sediment ponds and instead installed <br />a "treatment facility" composed of terrace ditches in accordance wiU1 Rule <br />4.05.2. It is therefore reasonable to require that the treatment facility <br />installed in lieu of sediment ponds be certifed as well. Therefore during <br />the permit revision process the Division requested, on page 2, item 5 of our <br />May 18, 1988 letter, that Walden Coal Company provide certified as-builts <br />of the sediment control installation. Walden Coal Company acknowledged <br />this request with a commitment to submit "as-constructed terrace surveys" on <br />page I-4(a) of the permit application. We therefore anticipated that this <br />commitment would be met. <br />Lastly, prior to initiation of the bond release process, the Division <br />transmitted a copy of the Handbook Memorandum on Bond Release on Permanent <br />Program areas (dated August 22, 1986) to Walden Coal Company. This document <br />itemized the components of the bond release package which includes as-built <br />post-mining topographic maps, certified cross-sections, and documentation <br />that the drainage system is functioning as approved. <br />Please call if you have any questions. <br />Sincerely, <br />J ~ <br />` /, <br />Catherine W.
