Rule 4.09. I (1 1)(a) The fill shall he napected for stabi(iry by a registered engineer or other
yrralified professional specielist experienced in construction of earth and rockfrll enrbnrrknrents
under the direction of u qua/ified professional engineer cu least qunrterlyl throughout the
construction and dururg the following critical construction periods'": (1)removal of all organic
material and topsoil, (2)placement of underdrninnge systems, (3) installation of surface drainage
systems, (4) plncemeru and compaction of fill nruterials, and (5) revegetution.
The permittee is in compliance with this rule. I This is a quarterly report. A registered engineer
accomplished both the inspection and certification.'' None of the critical construction periods
were encountered during the time period of the report.

The action is in compliance with this nlle. The inspection was accomplished on December 31,
2001. The report was prepared on January 3, 2002. The inspection report was submitted to the
Division under a letter of January 3, 20021, and received at the Division of January 14, 2002.'
The report included observations on instability, structural weakness and other (lack of) hazards.
