<br />GC-13.0 BACKCHARGFS <br />' In the event of default or defective WORK or materials which, in the sole judgment of <br />CONTRACTOR, SUBCONTRACTOR does not upon written notice, proceed to remedy <br />diligently, or if SUBCONTRACTOR, for any reason other than one for which it is entitled to <br />an extension of time, fails to proceed with the WORK as scheduled, CONTRACTOR may <br />complete the WORK and backchazge the related costs against SUBCONTRACTOR. To the <br />direct costs accumulated, CONTRACTOR will add thereto an amount of 5 percent to cover costs <br />of general administration and deduct the total from the next payments due SUBCONTRACTOR, <br />or require payment from SUBCONTRACTOR within 30 days. <br />GC-14.0 SITE CONDITIONS <br />' SUBCONTRACTOR acknowledges that it has satisfied itself as to the nature and location of <br />WORK, the general and local conditions which have a bearing thereon and any other matters <br />which can in any way affect the WORK or the cost thereof. SUBCONTRACTOR represents <br />that it has made its own interpretations, deductions and conclusions as to the difficulty and cost <br />of successfully performing and completing the WORK. <br />COMPANY and CONTRACTOR disclaim responsibility for data, documents, or information <br />of any nature whatsoever which directly or indirectly depicts site conditions whether provided <br />by CONTRACTOR or COMPANY. The accuracy of such information is not warranted and it <br />is the SUBCONTRACTOR'S responsibility to verify its accuracy. <br />COMPANY and CONTRACTOR assume no responsibility for SITE conditions which differ <br />from those ordinarily encountered or generally recognized as inherent in the WORK. <br />SUBCONTRACTOR shall beaz full responsibility for determining the SITE conditions to be <br />encountered and their effect upon the cost of the WORK, <br />GC-15.0 STANDARDS AND CODFS <br />Wherever references aze made in the CONTRACT regazding standazds and codes, the current <br />edition or revision on the date of this CONTRACT shall apply, unless otherwise expressly set <br />forth. Reference to such standazds and codes will be solely for technical information. <br />GC-16.0 CONTRACT INTERPRETATION <br />In case of conflicts, errors, omissions and/or discrepancies among the various CONTRACT <br />DOCUMENTS, the matter shall be immediately submitted in writing by SUBCONTRACTOR <br />to CONTRACTOR for clarification. Likewise, all claims and questions concerning <br />interpretation, clarification, compensation, extension of time or the acceptable fulfillment of this <br />CONTRACT on the part of SUBCONTRACTOR, shall be submitted in writing to <br />CONTRACTOR for determination. <br />SUBCONTRACTOR solely shall be responsible for requesting clarifications, instructions andlor <br />interpretations and solely shall be liable for any cost and expenses arising from its failure to do <br />so. <br />3-6 <br />
