Further, mineral has been defined as "an inanimate constituent of the <br />earth in a solid, liquid, or gaseous state, which, when extracted from the earth, is useable <br />in its natural form as a raw material for manufacturing or construction material." <br />Colorado Mined Land Reclamation C.R.S. §34-32-103(7). <br />Sand and gravel deposits are located at various places upon the subject property at depths <br />varying between 40 inches and 80 inches from the surface of the property in distinct and <br />insular deposits.. These deposits are covered over by topsoil and in some areas clay and <br />other soils, and gravel deposits as described neither constitute the entire surface of the <br />property nor underlie the topsoil of the entire property. <br />Gravel has been historically mined from the subject area in commercial quantities and has <br />been utilitezed as a raw material for the construction of roadways, road bases and other <br />projects, therefore, deposits which are the subject matter of this appplication clearly meet <br />the criteria for which a precedent exists. <br /> <br />00060 <br />
