Mitchell are the surface owners. <br />Sufficiency of right of entry: CRS Sec. 34-44-103 (Tenant in Common) allows amineral- <br />interest owner (such as Kinney) to enter, to search for, and develop minerals; CRS Sec. <br />34-48-105 (Right-of-Way/Eminent Domain) allows a majority mineral-interest owner <br />access if surface owner(s) will not negotiate lease regarding entry. <br />Legal right to enter: CRS Sec. 34-48-105 (Eminent Domain) allows amineral-interest <br />owner access if surface owners will not negotiate lease. Entry leases and rights of way <br />are expected to be negotiated as appropriate. <br />Applicant Kinney owns approximately 70% of oil, gas and minerals. <br />Pit Owner is not liable nor responsible for mortgages, liens, assessments, taxes or other <br />form of debt on surface of affected land.
