.*

Mr. Dean Massey
-3-
February 7, 1984
It has come to the Dl vision's attention that the water from the
Thompson Well may, 1n fact, be put to beneficial use. This is being
examined by the Division. The third alternative may be required if the
Thompson Well aquifer is determined to be a renewable resource which
cannot be materially damaged. As you know, renewable resources are
afforded maximum protection under the law, and aquifers are considered
a renewable resource. Therefore, before the Division proceeds further
on this issue, an investigation of the renewable resource needs to be
undertaken. As you may expect, 1f a renewable resource is established,
the Division will require appropriate prediction efforts and mining
methods to protect the resources.
If you would like to meet to discuss this Issue, please call me.
Sincerely,
~~Fc`~~
J~r~
David C. Shelton
Director
DCS/eap
Ooc. No. 9194
