Cattany <br />P P Division Director <br />29515 Routt County Road #27 Natural Resource Trustee <br />Oak Creek, CO 80467 <br />RE: 2004 Annual Hydrology Report Review, Eagle Mine Complex, #C-81-013 <br />Dear Mr. Watterson: <br />The Division has completed review of the 2004 Annual Hydrology Report (AHR) for the <br />Eagle Mine Complex. Reporting included water levels and quality monitoring of alluvial <br />wells, water level monitoring of bedrock wells, flow and quality monitoring of mine <br />discharge, both underground and spoil spring discharge workings, and monitoring of <br />• springs and seeps in the affected area. <br />General Comments <br />Figure 2, Hydrologic Monitoring Program Location Map was included in the <br />report. Unlike the map submitted with the 2003 Annual Hydrology Report, the <br />2004 map lacks both topography and hydrologic features (streams, ponds, lakes, <br />etc). Please submit a new AHR map including topography and hydrologic <br />features in accordance with the requirements of Rule 2.10 and Rule 2.04.7(4). <br />2. The mine is presently conducting a monitoring program established for periods of <br />temporary cessation, as outlined in Appendix D of Exhibit 29. Four prerequisites <br />are required for implementing this plan. The Division believes that prerequisites <br />#1-#3 have been clearly established. However, prerequisite #4 requires that <br />each annual hydrology report contain explicit verification that none of the seven <br />triggering events as described in Exhibit 29, page D-2 have occurred. The <br />Division identified text under Part 4.0 Summary and Conclusions stating, "No <br />significant, unpredicted, or adverse environmental impacts were detected during <br />hydrologic monitoring for 2004. Thus, under the temporary cessation monitoring <br />plan, none of the seven triggering events have occurred." While this statement is <br />explicit, it provides no verification that any one or more of the seven events did <br />not occur. Please provide specific evidence demonstrating that none of the <br />seven events occurred. For example, provide the pumping records for the No. 5 <br />mine well and 7 north angle well for the reporting period demonstrating that 2000 <br />gallons per minute over four consecutive weeks was not exceeded.
