COLOWYO COAL COMPANY, LP - 2004 ANNUAL HYDROLOGY REPORT COMMENTS AND RESPONSES TO CDMG 7/18/05 TECHNICAL ADEQUACY LETTER Item 1: The report form Outfall Inspection -Ponds used for the 1'st quarter 2004 inspections is inconsistent with other quarterly reports in that observations regarding the Wash Bay, Taylor Pump Holding, Aeration, West Overflow, East Overflow, and Sediment Sump Ponds are not recorded. The reports are included under Exhibit 18, Completed Annual and Quarterly Stock Pond lnspertion Forms. For consistency and to eliminate discrepancies, please add information to the report form as appropriate. Response: As you probably recall, at the time the first quarter 2004 impoundment inspections were performed, Colowyo was under the impression that the annual inspection frequency criteria applied to all non-NPDES ponds. The completed 1'st quarter 2004 Outfall Inspection -Ponds form reflects that belief under item (b) of that form which can be viewed under Exhibit 1A. As a result, the internal inspections completed for the impoundments listed in Item 1 were not incorporated into the Outfall Inspection -Ponds form for the 1'st quarter. After communications between Crellin Scott, Kurtis Blunt and Byron Walker, it was determined that in the future, inspection information would continue to be collected on a quarterly basis for these impoundments and said information would be presented on the Outfall Inspection -Ponds form. Subsequent inspections during the 2'nd, 3'rd and 4'th quarter 2004 demonstrate that process is being carried forward. In subsequent Annual Hydrology Reports, the inspection information for the ponds listed in Item 1 will only be reported in Exhibit 1A. In order to alleviate confusion with regards to the 2004 Annual Hydrology Report, Colowyo is providing three additional copies of the 1'st quarter 2004 inspections of the ponds in question. This information should be added immediately following the 1'st quarter 2004 Outfall Inspection -Ponds form found in Exhibit 1A. Item 2: Inspection reports provided under Exhibit 1A of the Annual Reclamation Report were duplicated under Exhibit 18. The annual inspection reports of Stock Tanks provided (Exhibit 16 do not carry the required certification. Please submit inspection reports for the tanks with the appropriate certitrcations (Rule 4.05.9(14)(b)].
