Fiddler's Green Circle <br />Englewood, Colorado 80111 <br />RE: Edna Mine, Moffat Area Ponitoring, <br />File C-80-001 <br />Dear Mr. Gontarek: <br />In a letter dated August 18, 1989 you expressed an opinion concerning required <br />groundwater monitoring for stability for mining in the Moffat area. <br />In preparing a response to your letter we reviewed the history of discussions <br />and negotiations which occurred between the Division and P8M concerning future <br />mining in the Moffat area. Please allow me to briefly reiterate the more <br />salient points: <br />As you may recall, since 1984 P8M has submitted 5 reports from Water, Waste <br />and Land which address stability in the Edna mine area. Each report contained <br />extensive mitigative methodology and monitoring recommendations. These <br />monitoring recommendations were included as a means to verify the assumptions <br />inherent in the analytical hypotheses contained in the reports. In turn we <br />accepted the reports with the condition that the recommended mitigative <br />methodologies and monitoring requirements be implemented by PBM. <br />Our position on these reports and their recommendations has remained <br />unchanged; the mitigative methodology and monitoring recommendations will be <br />implemented by P8M when mining in the Moffat area commences. <br />The recognition in the Settlement Agreement that Stipulation No. 4 had been <br />satisfied does not deviate from this position. Rather the fact that <br />appropriate analyses and mitigative and monitoring recommendations had been <br />made allowed the Division to agree that no additional stability analyses were <br />necessary and therefore Stipulation No. 4 had been satisfied. <br />215 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
