C-018-81. <br />Dear Mr. Gillis: <br />On June 10, 1988, I performed an inspection of the Deserado Mine refuse <br />pile sub-areas 1 and 2-3. <br />I am a professional engineer registered in the State of Colorado and my <br />experience fulfills the r~r,;rements of Colorado Surface Coal Mining <br />Reclamation Act. <br />The purpose of my inspection and certification was to ensure proper construction <br />of the refuse pile and to satisfy the rr~n 'rements of Rule 4.09 1 (11) of the <br />Colorado Mined Land Reclamation Board. <br />There are no apparent points of seepage in the pile, and there is no indication <br />of slope failure. The surface drainage facilities were adequately maintained <br />and were working properly. No subdrain system is required by our permit, since <br />geotechnical investigation for the disposal site revealed no ground water present. <br />Permanent out slopes are being constructed now on the toe of sub-area 1 and are <br />stable. <br />We have now, to date, a total of 389,678 tons of refuse placed in sub-area 1, <br />and 348,890 tons placed in sub-area 2-3. <br />Both the topsoil and subsoil piles for those areas have been seeded and are <br />stable. Refroval and stock piling of all organic material and topsoil prior <br />to disposal of refuse has been completed. <br />To the best of my knowledge, based upon my professional expertise, the <br />permanent refuse structures at the Deserado Mine are being constructed <br />in conformance with the prudent state-of-the-art of coal processing waste <br />bank construction, Further, the structures are being constructed in <br />compliance with the approved design, as specified within Section III-20 <br />of the approved permit docu[nPnts and depicted on Maps 76, 77, 82 and 83. <br />lkserado Afine <br />P.O.
