I{iger <br />September 12, 1994 <br />SECTION 16 FILL CONSTRUCTION UPDATE AND CERTIFICATION <br />On September 6, 1994 I performed an inspection of the Section 16 Fill. On <br />September 12, 1994, I interviewed Mr. James A. Kilter, Colowyo's reclamation supervisor about <br />his observations during it's construction. The purpose of this visit was to observe the condition <br />of the fill and to satisfy the requirements of CDMG Rule 4.09.1(11). Since the last inspection <br />on May 31, 1994 the remainder of the fill has been placed, graded, and topsoiled. Mr. Kiger <br />informed me that the topsoiled areas are scheduled for seeding in the next few weeks. <br />During the period since the last inspection four survey monuments were <br />established and the observation well completed. <br />The fill exhibited no appearances of instability, structural weakness, or other <br />hazardous conditions. No seeps were observed. Vegetation was evident on the majority of the <br />fill surface. <br />I am a mining engineer, registered in the State of Colorado, and experienced in <br />the construction of earth and rock fill embankments. Mr. Kilter is employed by Colowyo as a <br />reclamation supervisor and he personally observed the construction of the Section 16 Fill and <br />particularly the topsoil placement and seeding. <br />To the best of my knowledge, based on my professional expertise and the <br />information provided by Mr. Kiger, the Section 16 Fill has been constructed in conformance <br />with the prudent state-of-the-art for earth and rock fill embankment construction, as specified <br />in pages IIa-2 through lIa-4, Exhibit 19IIb and other applicable requirements of the approved <br />permit documents, a portion of CDMG Permit C-81-019. <br />Rupert G.
