Kiger October 7, 1994 WEST PIT EXCESS SPOIL FILL CONSTRUCTION UPDATE AND CERTIFICATION On September 28, 1994, I inspected the area in which the West Pit Excess Spoil Fill is being constructed. The purpose of this inspection was to observe the on-going construction of the rock drain, inspect the area from which the clay material was removed, inspect the fill for areas of water seepage or surface drainage, inspect the toe filter layer and to satisfy the requirements of CDMG Rule 4.09.1(lla). During the inspection it was observed that all the clay materials have been removed from the bottom of the drainage area between stations 0-30 to 20+50 of the West Pit Excess Spoil Fill, the rock drain had been successfully completed from stations 0-30 to 9+00 of the West Pit Excess Spoil Fill and the toe filter layer is complete from stations 0-30 to 2+00. A small slide area near the toe of the West Pit Fill, from stations 1+50 to 2+50, was being removed and the water source of the slide was being uncovered. This slide will be dug completely out and the water source discovered and drained to the west pit underdrain system. The slide poses no threat to the public as it is limited to a small area near the toe of the fill, but does not penetrate at depth the rock filter underdrain for the West Pit Fill. I am a mining engineer, registered in the State of Colorado, and experienced in the construction of rock and earthen projects for the purposes of mining activities. To the best of my knowledge, based on my professional expertise the West Pit Excess Spoil Fill has thus far been constructed in conformance with the prudent state-of-the-art methodology for earth and rock fill construction, as specified in pages Ia-2 through Ia-4, Exhibit 19Ib, and other applicable requirements of the approved permit documents, a portion of CDMG Permit C-81-019. \K' "'ry~~.'~~phen R.
