Kiger <br />January 22, 1993 <br />SECTION 16 FILL CONSTRUCTION REPORT <br />Attached are the first three sections of the Section 16 Fill Construction Report <br />written by Ed Moyer. This report covers the removal of the topsoil, preparation of the <br />underdrain area, construction of the underdrain, and the filter rock dumped over the drain during <br />the time from August 24, 1992 to December 18, 1992. <br />Mr. Moyer personally supervised the conswction of the Section 16 Fill to date <br />under my direction. Mr. Moyer visited the site numerous times during the construction to check <br />and document its progress and to make field modifications as needed. I also visited the site on <br />at least four occasions to observe the construction. Mr. Moyer and I conferred on numerous <br />occasions during this time. I have reviewed his report and discussed it with Mr. Moyer prior <br />to and after its preparation. I have also reviewed the design documents provided by <br />CTL/Thompson and the applicable portions of the Colorado Division of Minerals and Geology <br />(CDMG) Permit C-81-019. <br />I am a mining engineer, registered in the the State of Colorado, and experienced <br />in the construction of earth and rock fill embankments. Mr. Moyer is a geological engineer who <br />is experienced in the construction of earth and rock fill embankments. <br />The supervision and observation of the construction work was to insure proper <br />construction of the fill and to satisfy the requirements of CDMG Rule 4.09.1(11). <br />This fill exhibited no appearances of instability, structural weakness, or other <br />hazardous conditions at any point during this time period. Contained within the report are <br />interim certifications as to completion and compliance for each of the phases completed to date. <br />To the best of my knowledge, based on my professional expertise and that of Mr. <br />Moyer, the Section 16 Fill has thus far been constructed in conformance with the prudent state- <br />of-the-art for earth and rock fill embankment construction. Further, the fill has thus far been <br />constructed in compliance with the approved design, as specified in pages IIa-2 through IIa-4, <br />Exhibit 19IIb and other applicable requirements of the approved permit documents, a portion of <br />CDMG Permit C-81-019. <br />lQiG~ <br />Robert G.
