Rule 4.09.1(1 l)(a) The fill shall be inspected for stability by a registered engineer or other
qualified professional specialist experienced in construction of earth and rockfrll embankments
under the direction of a gualifaed professional engineer at least quarterly) throughout the
construction and during the followtng critical construction periods2: (1)removal of a[I organic
material and topsoil, (2)placement of underdrainage systems, (3) installation of surface drainage
systems, (4) placement and compaction of fill materials, and (J) revegetatlon.
The permittee is in compliance with this rule. 'This is a quarterly report. A registered engineer
accomplished both the inspection and certification. 2 Installation of surface drainage systems was
a critical construction period encountered during the time period of the report.
Rule 4.09.1(11)(b} The qualifzed registered engineer shall provide to the Division a certifted
report within 2 weeks after each inspection) that the f ll has been constructed as specified in the
design approved by the Division. 2The report shall include a description of any appearances of
instability, structural weakness, and other hazardous conditions observed during the inspection.
A copy of the report shall be retained at the mine site.
The certification indicates that the Fill was inspected on June 9, 2004. The report was to be
provided to the Division within two weeks after the inspection (June 23, 2004), PAP, Exhibit 19,
Section I, page Ia-4. The report was dated June 9, 2004 and submitted under a letter of June 15,
2004. It was received at the Division on June l7, 2004. 2 Thus the report was timely. The report
included a description (none) of the appearance of instability, structural weakness, or other
hazardous conditions.
