Cattany <br />Division Director <br />Natural Resource Trustee <br />Rule 4.09.1(11)(a) The fall shall be inspected for stability by a registered engineer or other <br />qualified professional specialist experienced in construction of earth and rockfill embankments <br />under the direction of a qualified professional engineer at least yuarterlyl throughout the <br />construction and during the following critical construction periods2: (1)removal of all organic <br />material and topsoil, (2)placement of underdrainage systems, (3) installation ofsurface drainage <br />systems, (4) placement and compaction offll materials, and (S) revegetation. <br />The permittee is in compliance with this rule. I This is a quarterly report. A registered engineer <br />accomplished both the inspection and certification. 2 Installation ofsurface drainage systems was <br />a critical construction period encountered during the time period of the report. <br />Rule 4.09. i(11)(b) The qualified registered engineer shall provide to the Division a certified <br />report within 2 weeks after each inspection) that the fill has been constructed as specified in the <br />design approved by the Division. 2The report shall include a description of any appearances of <br />instability, structural weakness, and other hazardous conditions observed during the inspection. <br />A copy of the report shall be retained at the mine site. <br />The certification indicates that the fill was inspected on March 24, 2004. The report was to be <br />provided to the Division within two weeks after the inspection, PAP, Exhibit 19, Section I, page <br />Ia-4. The report was dated March 31, 2004 and submitted under a letter of March 31, 2004. It <br />was received at the Division on April i, 2004. 2 Thus the report was timely. The initial report did <br />not have a report on the appearance of instability, structural weakness, or other hazardous <br />conditions. An amendment to the report (April 16, 2004) was received at the Division on April <br />19, 2004 that included the missing information.
