Stormwater nonage apadty is in addition to design sediment <br />storage and any permanent storage apacity. Kerr inspects all sedimentation ponds on a <br />quarterly buffs. Inspections include evaluation of accumulated sediment levels relative to design <br />sediment storage apadq to verify that deign normwater storage apaciry is maintained at all <br />times. ff inspections indiate that sediment accumulations ue at or nee the design sediment <br />level, Kerr removes accumulated sediment from the pond(s) within a reuonable period (typially <br />30 to 60 days) following the inspection. Both pond inspection reports and documentation of <br />pond cleanout ue retained at the minaite and ue available for inspection by authorized agency <br />• representatives. Based on direct observation of pond storage levels at the time disr~tuge <br />occurred, the discharge resulted from: <br />Rainfall or snowmelt runoff volumes leu than or equal to the design 10 yeu, 24 <br />hour storage volume <br />^ Rainfall or snowmelt runoff volumes grater than the design 10 yeu, 24 hour <br />storage volume <br />Based on the preceding informuion, Kerr respectfully requests rhu the a7uer Quality Control <br />Division approve a stormwater exemption for aceedance of effluent limitations consistent with <br />exemption and associated burden of proof provisions u outlincd in Permit COG850021.
