Kerr Coal Company • Mur Mine (COPS Permit COG850021)
stormwater Exemption Requuts
Dear Ms. Nelson:
Kerr Coal Company (Kerr) previously submitted stormwater exemption requuts for effluent
limitation exceedancu on 4/1/93, 4/7/93, 4/14/93, 4/21/93, 4/29/93 and 5/5/93. These
requests were submitted on a recently developed "checkoff form" to simplify both reporting
and WQCD review. As indicted by your letter of June 8, 1993, this general approach is
acceptable but the request submittals were not adequate to meet WQCD documentation
requirements for the spedfic information items noted in your letter.
On receipt of your lever, we reviewed vuious option to provide the required information and
contacted Jon Kubic of your office to discuss both option and proposed documentation
approach. As a result of these discussions, the stormwater exemption request form wu revised
and a drab wu submitted for WQCD rcvieav and comment. Further disassion resulted in
• concurrence that the revised form and proposed approach for documentation of climatic
conditions would meet WQCD informational needs. We are, therefore, submitting with this
letter stormwater exemption requests for the above noted dace on the revised forms.
Separate exemption requests ue provided for each dace on which an effluent limitation
exceedance occurred. Each exemption request includes the exemption request form letter and
appropriate water sample analysis report sheet(s). In addition, in order to document snowmelt
or stormwuer runoff conditions, monthly climatic data summary sheets from the Nuional
Weather Service Field Office in Walden, Colorado ue provided for each month during which
one or more exemptions ue requested
Please review the ummpanying stormwater exemption requests and feel free to contact me with
any questions or comments. We appretaate your comidention and Jon Kubic's assistance in
resolving this matter.
Sincerely,
• cc J. KubirJWQCD
R Price/DMG (w/attachments)
J.
