Of Nita:a• ntD::;l,,., ; <br /> 1313 Sherman Street, Room 723 <br /> Denver, CO 80203 <br /> Re: Nottingham Sand and Gravel, Inc. <br /> Permit No. 78-352 (Eagle Pit) and <br /> Permit No. 77-343 (Avon Pit) <br /> Dear Dave: <br /> Nottingham' s Permit No. 78-352 and Permit No. 77-343 were <br /> issued April 11, 1979, and it is time for an annual report <br /> to the Board on activity at those pits. <br /> However, circumstances of which the Board is, I believe, <br /> already aware have prevented Nottingham from doing any <br /> significant work at the Eagle Pit. Following the heated <br /> Board meeting last year when the Board granted the permit <br /> for the Eagle Pit, a lawsuit was filed by the Goldman <br /> interests (disgrunted adjacent property owners) against the <br /> Board and Nottingham. The Goldmans also complained of <br /> Nottingham to the Board of County Commissioners of Eagle <br /> County, giving rise to rehearings on its County-granted <br /> Special Use Permit. The local problems have now been largely <br /> resolved, and the Special Use Permit continues in force. <br /> The delay occasioned by these problems, however, prevented <br /> Nottingham from even moving its equipment onto the Eagle <br /> site until early 1980. Excavation has just begun at this <br /> pit. <br /> Consequently, no material or reportable progress has been <br /> made at this pit, and Nottingham is effectively still in the <br /> same position as when it appeared before the Board a year <br /> ago. The maps and plans included in the original application, <br /> as technically amended by the upgraded revegetation plan <br /> submitted to you with an accompanying letter dated February <br /> 15, 1980, are essentially current and accurate information <br /> regarding the status of this pit. Nottingham therefore <br /> submits this letter in lieu of any annual report on the <br /> Eagle Pit. <br />
