Phillipsr being duly sworn, states <br />as fellows. <br />1. I hold the position of assistant attorney Gen- <br />eral, Natural Resources Section. Office of the attorney Gen- <br />eral. <br />2. Since August 1982, I have been ane of the attor- <br />neys responsible for representing defendants in Lgukencnen <br />et al. v. Colorado Mined Land Reclartation 8oardz_et_al.r <br />No. d2 CV 3312. <br />3. The following statements are based on my personal <br />participation in the above-referenced case, my thorough <br />review of my litigation files compiled on this case. and my <br />litigation experience as a practicing attorney. and are <br />true to the best of my knowledge and belief. <br />4. Tne amount of attorney general Staff time expended <br />in representing defendants in the above referenced Case was <br />in large part a direct result cf the fact that plaintiffs' <br />attorneys continually raised new issues and arguments. <br />This practice required more, anC much rtore extensive. filings <br />on defendants• behalf than would otherwise have been neces- <br />sary.
