Burden of Proof Requirements <br />The permittce has the burden of proof when seeking relief from total suspended solids ('I'SS), total iron aad/ar settleable <br />solids (SS) limitations. Outfalls 001, 002, 003, 005, 006, 007, 008, 009, 025 end 028 are eligible for relief. The remaining <br />permitted outfalls are not eligible. <br />Relief may be granted for each discharge occurrence only whey necessary and shall not be granted when the permittce has <br />control over the discharge. The permittce should endeavor to meet the primary limitations whenever possible. The <br />pemuttce will need [o show that ezceedence of the applicable limitations was caused by precipitation and no other source and <br />that the discharge was beyond their control. <br />s) For rainfall. to waive TSS and total iron limitatioos, it is necessary to prove that discharge occurred within 48 hours <br />after measurable precipitation has stopped. in addition, W waive settleable solids limitations, it is aeorssary to prove that <br />discharge occurred within 48 hours after prceipitation greater than the 10-year, 24-hour event has stopped. <br />b) For snowmelt, to waive TSS and total iron limitations, it is nocessary to prove that discharge occurted within 48 hours <br />after pond inflow has stopped. In addition, to waive settleable solids limitations, it is necessary to prove that discharge <br />occurred within 48 hours after pond inflow volume greater than the 10-year, 24-hour event has stopped. <br />Should a precipitation evrn[ or snowmelt occur, the perntittce shall submit adequate proof.ia order for an exemption to be. <br />claimed. Said proof shall be submitted as an attachmwt to the Discharge Monitoring Report (DMR) for the appropriate <br />period. The Division shall detemuae the adequacy of proof. As part of this determination, the Division shall evaluate <br />whUher the pernrillce could have controlled the discharge in surL a meaner that primary limitations could have been mU. <br />All manual dewatering of the ponds shall meet TSS and total iron limitations. <br />3. Post-Mining Areas <br />Cotnategcing at the lime alive mining has ceased and surface areas have been returned to the required contour all applicable <br />discharges may be eligible for limitations other than those spceified in Parts I.A.2. and I.A.3. These post-mining limitations <br />shall remain in effect until bond release.
