Burden of Proof Requirements The permittce has the burden of proof when seeking relief from total suspended solids ('I'SS), total iron aad/ar settleable solids (SS) limitations. Outfalls 001, 002, 003, 005, 006, 007, 008, 009, 025 end 028 are eligible for relief. The remaining permitted outfalls are not eligible. Relief may be granted for each discharge occurrence only whey necessary and shall not be granted when the permittce has control over the discharge. The permittce should endeavor to meet the primary limitations whenever possible. The pemuttce will need [o show that ezceedence of the applicable limitations was caused by precipitation and no other source and that the discharge was beyond their control. s) For rainfall. to waive TSS and total iron limitatioos, it is necessary to prove that discharge occurred within 48 hours after measurable precipitation has stopped. in addition, W waive settleable solids limitations, it is aeorssary to prove that discharge occurred within 48 hours after prceipitation greater than the 10-year, 24-hour event has stopped. b) For snowmelt, to waive TSS and total iron limitations, it is nocessary to prove that discharge occurted within 48 hours after pond inflow has stopped. In addition, to waive settleable solids limitations, it is necessary to prove that discharge occurred within 48 hours after pond inflow volume greater than the 10-year, 24-hour event has stopped. Should a precipitation evrn[ or snowmelt occur, the perntittce shall submit adequate proof.ia order for an exemption to be. claimed. Said proof shall be submitted as an attachmwt to the Discharge Monitoring Report (DMR) for the appropriate period. The Division shall detemuae the adequacy of proof. As part of this determination, the Division shall evaluate whUher the pernrillce could have controlled the discharge in surL a meaner that primary limitations could have been mU. All manual dewatering of the ponds shall meet TSS and total iron limitations. 3. Post-Mining Areas Cotnategcing at the lime alive mining has ceased and surface areas have been returned to the required contour all applicable discharges may be eligible for limitations other than those spceified in Parts I.A.2. and I.A.3. These post-mining limitations shall remain in effect until bond release.
