In your next report (for 2003), please change 2001 to read 2002 in the notation for azea <br />EP037 on Exhibit 7 map. In the text, Colowyo Coal Company, L.P. (Colowyo) states that this <br />azea was reseeded in 2002 and deleted from the 2001 listing. <br />Item 2. Your Permit (page 2.05-57 of the Permit Application Package) requires a random <br />sampling of topsoil. None were reported, nor did I fmd where any have been reported as faz back <br />as 1994 (ARRs). This item was identified in the Division of Minerals and Geology (Division) <br />review dated October 25, 2002, of your 2001 ARR. The December 6, 2002 response by Colowyc <br />was that it would be addressed in the South Taylor revision. However, this revision was not <br />forthcoming. Please submit a technical revision [a change in the environmental monitoring <br />program, Rule 1.04(136)] for consideration that deletes this requirement so as to be in effect <br />before your 2003 ARR submission, or, accomplish the monitoring and include your findings in <br />your 2003 ARR. <br />Item 3. In your 2003 ARR, please revise the Annual Report Map legend for "offsite fill azeas" to <br />read "Excess Spoil Fills". Although not listed in the dictionary section of the Rules, offsite (off <br />site, off-site) has a connotation as being outside the permit boundary [see Rules 1.04(17), <br />2.04.6(1)(c), 2.06.7(4)(e), 4.01.1(7), 4.14.1(2)(b), etc]. <br />Item 4. Please find attached an internal Division memorandum from Janet Binns to Byron <br />Walker, 09119!03, Re: Colowyo 2002 ARR. Please provide clarification and information in <br />response to her questions. In this regazd, as we discussed by telephone this afternoon, has <br />Colowyo included those azeas affected by fire as "disturbed areas" of the Permit.
