,,~,.. <br />3.4 Notice of Intent to Continue <br />Except as provided in Rule 1.6, the operator shall annually file on <br />the anniversary date of the permit a notice of Intent to continue <br />mining operations. The notice of Intent shall contain an annual fee <br />of fifty dollars (operators who are units of county government are <br />exempt from annual fees) and a map or statement that shall indicate: <br />(a) The land affected during the preceding year: <br />(b) The land to be affected during the coming year; and <br />(c) Any land reclaimed during the preceding year. <br />For operators holding a special, 111 permit, your attention is directed <br />to the following provisions from C.R.S. 1973, 34-32-116(a): <br />34-32-116 (a) On the anniversary date of the permit each year, the <br />operator shall submit a reclamation plan and map showing <br />the affected land and other pertinent details, such as <br />roads and access to the area and reclamation <br />accomplished....The reclamation plan prepared by the <br />operator shall be based upon provisions for, or <br />satisfactory explanation of, all general requirements for <br />the type of reclamation chosen. The details of the plan <br />shall be appropriate to the type of reclamation designated <br />by the operator and based upon the advice of technically <br />trained personnel experienced in that type of reclamation <br />on affected lands and upon scientific knowledge from <br />research in reclaiming and utilizing such lands.... <br />If the annual reports are not received by 60 days from the date of this <br />letter, inspections of the sites of these operations will be scheduled to <br />assess compliance.
