The AHR documents that these inspections were conducted by inclusion of inspection reports. <br />Rule 4.05.9(14)(a) Such inspections shall be made regularly during construction, upon completion of <br />construction, and at least yearly until removal of the structure or release of the performance bond. <br />Ponds were not under construction, nor was construction completed, during the year. Copies of <br />annual inspections were included in the report. <br />Rule 4.05.9(14)(6) The qualified registered professional engineer shall, promptly after each <br />inspection required by 4.05.9(/4), provide to the Division, a certified report that the impoundment <br />has been constructed and/or maintained as designed, and in accordance with the approved plan and <br />the applicable regulations. <br />Reports were submitted in accordance with this rule during the year. <br />Rule 4.05.9(] 4)(c) A copy of each certified report shall also be retained at or near the mine site. <br />Copies of the inspection reports were found on file during inspections by the Division during the <br />year. <br />Rule 4.05.9(15) Certified inspection reports required by 4.05.9(14) for a[I impoundments shall <br />include discussion of: <br />Rule 4.05.9(15)(a) Any appearance of erosion, instability, structural weakness or other hazardous <br />conditions; <br />The reports include such information. <br />Rule 4.05.9(15)(6) Existing and required monitoring procedures and instrumentation; <br />The reports include such information. <br />Rule 4.05.9(15)(c) The depth and elevation of arty impounded waters at the time of the certified <br />report,' <br />The reports include such information. <br />Rule 4.05.9(15)(d) Existing storage capacity of the impoundment; and <br />The reports include such information. <br />Rule 4.05.9(15)(e) Any other aspects of the structure affecting stability, or requiring maintenance. <br />The reports include such information. <br />Page 3 of 7 pages, 2005 AHR Review, April 14, 2006 <br />
